Court: Obama must be ‘constitutionally’ eligible

"For the first time in dozens of court cases challenging Barack Obama’s eligibility to be president, a judge has ruled that Obama must, in order to be a candidate on the Georgia ballot for president in 2012, meet the constitutional demands for candidates for the office.

A hearing has been scheduled later this month for evidence on the issue that has plagued Obama and his presidency since long before he took office. At issue is the constitutional requirement that a president be a “natural-born citizen.” Some allege he was not born in the U.S. as he has claimed and, therefore, is not eligible.

Others, including top constitutional expert Herb Titus, contend that the term “natural-born citizen,” which is not defined in the Constitution, would have been understood when the document was written to mean the offspring of two U.S. citizens. That argument is supported by a 19th-century U.S. Supreme Court decision

Under that standard, Obama could not qualify, because his father, as identified on the “Certificate of Live Birth” image released by the White House, was a foreign national who came from Kenya to study in the U.S. and never was a citizen.

The ruling came today from Judge Michael M. Malihi of the Georgia state Office of State Administrative Hearings."

I can't stand Obummer however, a child of even 1 us born citizen is still a citizen under the law period. To say otherwise strips millions of people of their god given rights as citzens of my country.

"Natural" born citizen, is the term used when it comes to eligibility for the Presidency, which seems to require that both parents are US citizens. This was apparently upheld by a Supreme Court ruling. It would not apply to regular citizenship of the US, where one parent is sufficient. Much the same as someone born outside of the US, with neither parent a US citizen, can still become a bonafide citizen himself, with all the rights that goes along with it. He couldn't, however, run for the Presidency. I believe Arnie schwarzenegger falls into that category.

The way (I) understand the Natural born clause it means: Someone born either on the Soil of the US; or to a parent whom is a US citizen even if they are on foreign soil. McCain was allowed to run and had he won could have held office even though he was born in Panama.

That would mean he was not "natural born" would it not if we followed the other line of thought?

If this were other interpretation of the clause held to be true at least then we could try to get rid of all the freaking anchor babies! A silver lining...

I hate political mumbo jumbo and personally speaking I plan on voting for Mickey Mouse for Prez and Donald Duck for VP. Perhaps if we vote in a 'toon these jackals will get a freaking clue!

I believe McCain was born on a US military base in Panama, which would be classified as US territory, much the same as an embassy. Both his parents were US citizens.

I know what you mean, BL, politics is something of a freak show. If there was a legitimate case that Obama is illegible, why didn't the Republican party that is chock full of lawyers, judges, and rich powerful people not stop him from running for the Presidency? Heck, if they don't know the law inside out, who does?

Obama has brought on all of this due to actions of his own.

There are requirements for this status based on his date of birth. I would assume, without looking up information on his mother, that she met these requirements, but I don't know for sure. I also do not know if his parents had him registered for dual citizenship.

"For persons born between December 24, 1952 and November 14, 1986, a person is a U.S. citizen if all of the following are true (except if born out-of-wedlock):

The person's parents were married at the time of birth
One of the person's parents was a U.S. citizen when the person was born
The citizen parent lived at least ten years in the United States before the child's birth;
A minimum of 5 of these 10 years in the United States were after the citizen parent's 14th birthday."

Why I say he brought this on himself is:

1. The long form they finally put out was exposed as a fraud. That means there is a problem somewhere.

2. He has spent more than 1 million, it was reported, to fight having this issue brought before the courts.

3. He is the first President to apply for college aid as a foreign student, then deny he was a foreigner.

4. He is the first President to have a Social Security number from a state he's never lived in.

5. He is the first President to hide his medical, educational, and travel records.

If they released the claimed original document, from Hawaii, then issue solved. If the courts agree to hear evidence to pursue this issue, then there must be something to it.

Time will tell.

I agree. And surely the court has the power to demand that Hawaii hand over the original document. Even if there's nothing amiss, the way Obama has conducted himself over the issue makes it seem suspicious; as if there's something he wants to hide. And of course, it's given his political enemies a field day.

I can't help comparing his attitude to that of John McCain, when his birth details were in question. He immediately produced his original certificate of birth. Why didn't Obama do likewise? It's an interesting debate though. Because if McCain had not been born on a US military base, and just in plain old Panama, I doubt he would have qualified as a "natural born" citizen either, and would therefore, have been illegible to run for President. It will be interesting to see what the court decides.

This is what you get when a bunch of idiots, who can't even state what the president does, votes. Why did they come out? Because Obummer made himself a rock star or sorts.

He was too green to be holding an office like this, where did he come from Il. Home of some of the worst dirt-bag politicians Springer, the guy with the he creepy hair just to name two. Does anyone ever look at these things when they vote? There should be some sort of IQ test given before someone is allowed to vote, along with a drug test! Crackheads should not be voting IMHO.

Hopefully the courts will reveal that we were not lied to and we did not have someone un-eligible in office. If that were true the implications are a bit frightning... Can we say Arnie!

A quick Google search brought up a ton of sites devoted to Obama's eligibility to be President. I've included a link to one of the less extreme ones, and also an interesting looking book. You know truth is indeed stranger than fiction. If an author had written a book of fiction about this, prior to the events, no one would have believed it could actually happen. The only thing to stop all the speculation -- which is perfectly natural given the circumstances -- is a public examination of all the facts, in a court of law. It's great to see that the wheels are finally in motion towards that end.
